What sort of nominee are the five Democrats in the Senate Judiciary Committee who voted against John Roberts on Thursday waiting for? More importantly, why are they wasting political capital on a capable Supreme Court nominee who is not locked in an ideological prison? The nominee, who now must pass a vote of the full Senate, is surely a conservative, but he has a keen intellect and, unlike others on the highest court in the land, possesses an open mind. This is a man who in the best traditions of the Supreme Court will grow on the job.
Given the president's track record in nominating to the federal bench, John Roberts is as good as it gets.
