Calhoun County deputies Friday served a warrant for Matthew Dennis Ortiz, 24, of Sevierville, Tenn. Ortiz is charged with criminal negligent homicide in the death of James Jerome McLendon on May 9, 2011.
The indictment, signed by Calhoun County District Attorney Brian McVeigh, states that McLendon was a passenger in Ortiz’s vehicle at the time of his death and that Ortiz was driving while intoxicated and over the speed limit.
Calhoun County Chief Deputy Matthew Wade said he didn’t know the specifics of the case other than it had been handled by the Alabama State Troopers and that the indictment came directly from a grand jury.
Attempts Tuesday to reach a spokesman from the Alabama State Troopers were unsuccessful.
Ortiz was being held Tuesday in Calhoun County Jail, with bond set at $100,000. No court date had been set.
