Local business owner charged with assaulting police officer

Police charged a local restaurant owner with assaulting an officer Monday on Noble Street, Anniston police said.

David Martin Mogil, 48, owner of Damn Yankees, was charged Monday morning with felony second-degree assault as well as disorderly conduct and resisting arrest, both misdemeanors.

Mogil deferred all comments to his attorney, Donald Stewart. Attempts to reach Stewart Tuesday were unsuccessful.

Mogil was reportedly standing outside a business on the 900 block of Noble Street shouting obscenities and interfering with business when an off-duty Anniston police officer approached him, Sgt. Chris Sparks said. The officer told Mogil he was under arrest for disorderly conduct and Mogil fled to a restaurant on the 900 block of Noble Street, Sparks said.

The officer followed Mogil inside and when he attempted to arrest him again Mogil punched the officer multiple times in the face, according to Sparks. The officer suffered minor cuts to his face, but did not require medical treatment.

Several other officers arrived at the restaurant as Mogil was about to flee again and he was arrested at the scene, Sparks said.

Mogil paid his $11,000 bond around 9:30 Tuesday morning and was released from the Anniston City Jail, the sergeant said. Mogil’s court appearance is scheduled for April 8.
