Attorneys representing 66-year-old Roger Harris filed a suit against the pharmacy chain in 2011, saying Harris’ supervisor and co-workers created a workplace filled with derogatory remarks regarding the pharmacist’s age.
Despite Harris’ objections, the suit said, his supervisor and district manager failed to correct the behavior, and Harris later received a series of inaccurate and unfounded reprimands concerning his job performance.
Harris was fired on Aug. 17, 2009, and his replacement was under the age of 40 and paid significantly less than Harris, according to court records.
Harris filed a charge with the Equal Employment Opportunity Commission on Dec. 1, 2009. The case received a dismissal in Nov. 23, 2010. If the EEOC does not bring a suit against an employer, a plaintiff has the right to file a suit 90 days after receiving notice from the commission, which Harris did in February of 2011.
The jury today found that CVS fired Harris due to his age and committed a willful violation of the Age Discrimination in Employment Act.
Efforts to reach Harris, his attorneys or lawyers representing the Rhode Island-based CVS Caremark were not immediately successful this evening.
